We can all agree that sexual assault is an issue that needs to be addressed. There is, however, a lot of debate over the best way to go about remedying the problem. A recent bill that has passed the California Senate hopes to curb the high rates of sexual assault on college campuses by requiring people to obtain expressed verbal or written consent prior to engaging in any sexual activities.
While we're sure the lawmakers have the best of intentions here, we have serious doubts about the efficacy of such a measure. While it will certainly help to eliminate implied consent as an argument a perpetrator can make on their behalf, it doesn't address consent given under the influence of alcohol or out of fear of danger.
